Court stops FG from renaming UNILAG

A Federal High Court in Lagos on Monday granted an interim order restraining the Federal Government from renaming the University of Lagos.
The order was granted by Justice Stephen Adah, who was ruling in the suits brought against the May 29, 2012 renaming of the institution by the students and alumni of the University of Lagos.
The court, however, advised the litigants to harmonise the suits into one and adjourned further hearing till July 4.
The defendants in the suits are UNILAG, the UNILAG Governing Council, the UNILAG Senate, the Attorney-General of the Federation and the National Assembly.

President Goodluck Jonathan had last month renamed the University of Lagos after the late businessman and acclaimed winner of the June 12, 1993 presidential election, MKO Abiola.

The renaming of the institution as Moshood Abiola University was greeted by protest from the students and staff of the school. Others criticized the president for not following due process in renaming UNILAG. They insisted that the president should have consulted with the National Assembly before making the pronounciation on democracy.

President Jonathan on Sunday during a presidential media chat with selected journalist said that he did not breach the consititution of Nigeria in renaming the University of Lagos. He said the renaming the insitution is similar to the process the president can  declare state of emergency before subjecting the matter before the National Assembly.

He supported his arguement by saying that he just signed the act establishing the University of Uyo, a university that according to him have being producing Phd graduates.

    This is more than absurd. Who is Mr President fooling? How can he compare his power for declaring a state of emergency with his statutory power to rename an institution.It is like comparing death with sleep.   More so, the procedure stipulated by law for the exercise of each power is VERY different . This LAME explanation is even an insult on the psyche and the collective intelligence of Nigerians. One of the attributes of a leader is the humility to accept he/she is wrong when he/she is wrong.Plesae spare us

      It does not insult my intelligence Baba. Read the law well who is the visitor to the University? What are his power? Respect your President. Do not naively think that if he takes decision that you dont like you must denigrate your president if you are a Nigerian.

        U are the one that needs to read the law well. what are the powers of a visitor under the relevant law? Can the visitor wake up one morning and rename a creation of statute without due consultation with the University Council and recourse to that statute.I dont think so. The court will eventually vindicate this position which it has already started doing.

        And pls tell how or where hav I denigrated or not respect the  President?Did I abuse or called him names?I think I only address the issue and not the person. Is ii bcos I disagreed wiht him? It is my fundamental right to disagree and the fact that he is the President makes no difference at all. In fact, that he is a public figure engaged in public acts strengthen my right of disagreement. My respect of him as President does not require me to keep quiet when I think he is wrong.     Sometimes Mr Jonathan our president u make  me feel disappoined in your degrees and professorship. For Gods sake what has the  re-naming of  UNILAG got to do with all this problems in Nigeria at hand.
                      Our Universities lacks at least 60% of what it takes to make Standard Uni.
                      The Lecturers/Teachers  are been owned for months all over the Schs.
                      Level/standard of education going down daily in Nigeria which makes our Certificate Unacceptable all over ther world.
                      Lagos shagamu/benin  road is an eye saw ppl dieying there every  minutes
                      Niger Bridge due for Maintanance yet nothing serious is been done 
                      Boko haram and their Bombing has become part of Nigeria`s daily activity
    So with this few points tell me what Concern`s u mr president  with renaming sch amidst all this troubles. Mr President check yourself with ur Carcuss  if u re moving foward or Backward . but i think very very backward . . . .  open ur eyes

    Unilag is a federal school and not a government ministry. It is federal because it was set up by a FEDERAL LAW. It is not that is an arm, ministry, parastatal or agency of the federal government. It is an autonomous institution and the President or any other person can only exercise the powers given them under that federal law. The Nigerian President is not given any powers under the law that established Unilag. He is no more relevant under that law than the Lagos State governor.  Federal laws are made by federal legislators and not by the President. Any institution set up by federal law can only be changed by the federal legislators. Under military rule, both presidential and legislative powers were under one person–the military dictator, but this is no longer the case, and those who keep saying the President can change the name of a federal school should educate themselves before miseducating other people. You might as well say he can change the name of the country because he is the President, and that is clearly ridiculous.
