Lack of legal representation responsible for prison congestion- Bolaji Ayonrinde

The newly constituted board of the Legal Aid Council of Nigeria is considering some bold reforms to tackle the challenge which prison congestion poses in the country.

In an interview with our judiciary correspondent, Shola Soyele, the Chairman of the Board, Senior Advocate of Nigeria, Bolaji Ayorinde says lack of legal representation is one of the major causes of prison congestion and the Legal Aid Council has big plans to partner with legal practitioners to combat this issue.

    The starting point towards tackling the problem posed by prison conjection in Nigeria is to replace all police prosecutors across the country with qualified legal practitioners. It will also help the Criminal Justice Reform. Police prosecutors are fond of obtaining remand order from the court & abandon the trial of the accused.

    Also a viable legal department manned by qualified legal practitioners should be established in all police commands across the country. This will reduce the menace of waiting for DPP’s advice in some case while the accused rottens in prisons.

    The Legal Aids Council can ensure that appropriate legal framework is put in place to ensure that it will be the duty of every judge/court to inform any accused person brought before it of his legal right to lawyer of his choice & the right of the accused to have his response recorded in the proceedings.

    Where the accused is not represented by counsel & the non-representation is due to want of resources, the court shall immediately inform the Council and/or NBA. This will attract prompt response from the Council/NBA to secure accused bail or immediate trial.

    Millions of Nigerian do not even know that legal representation in court is a fundamental right under the Nigerian law & the courts(especially lower courts) have not been of help in this regard.
