Counsel to former Ogun State Governor, Gbenga Daniels has asked that the court dismiss all 43 charges against his client.

Mr. Daniels whose court case resumed today and counsel for the embattled governor, Professor Taiwo Osipitan said the charges, which were brought by the Economics and Financial Crimes Commission ought to be dropped as the crime fighting unit lacked jurisdiction.

Osipitan while filing the motion to have the charges quashed, called the EFCC’s actions illegal and unconstitutional, adding that the Federal Government, acting through the EFCC has no leagal right to prosecute alleged crime against the state as levelled against the defendant.

Counsel to the crime fighting unit, Rotimi Jacob disagreed with the motion raised by Daniel’s counsel, saying in his response that the motion is simply a ploy to hamper the ongoing trial.

Presiding judge, Justice Olanrewaju Mabekoje adjourned sitting to tomorrow, for the determination of the issue of the EFCC’s jurisdiction.

The accused was sworn into office on 29 May 2003 and was re-elected for another term in 2007. His second term came to an end on 29 May 2011.
