Prosecutors in the manslaughter case against Michael Jackson’s doctor Conrad Murray withdrew their petition demanding $100 million (£62 million) in restitution.

Deputy District Attorney David Walgren told the judge handling the case that he was withdrawing the restitution request after speaking with Jackson’s mother, Katherine, and attorney for his father, Joseph.

Murray remains in jail after being convicted in November of involuntary manslaughter. He was sentenced to serve four years in jail, but his incarceration will be cut in half due to overcrowding and California’s budget crunch.

Murray was found guilty of administering the fatal dose of anaesthetic propofol which cost the Thriller hitmaker his life and he was sentenced to four years behind bars on an involuntary manslaughter charge.

The Judge was supposed to consider much money Murray should hand over to Jackson’s family, with estate administrators estimating the singer would have earned at least $100 million if he had lived and performed his This Is It concerts in London.

The request for restitution was officially withdrawn on Wednesday as the Los Angeles District Attorney’s Office spokeswoman Jane Robison announced that they have informed Judge Pastor that the Jackson family is not seeking restitution and asked that the matter be taken off the calendar.
