Court restrains INEC on Ogun polls

A Federal High Court in Lagos has restrained Ogun state’s Independent Electoral Commission (OGSIEC) from taking any  further steps in respect of the local government elections scheduled for the 21st of July.

Presiding Justice Charles Archibong in a ruling delivered on Monday, specifically restrained the commission pending the hearing before him of contempt proceedings against some principal officers of the electoral commission and some chieftains of the People’s Democratic Party (PDP).

The committal proceedings initiated by the Chairman of the Ogun PDP’s Executive Committee, Mr Adebayo Dayo and his secretary, Semiu Sodipo, is against purported officials of the State’s Caretaker Committee of the party, including Chief Ireti Oniyide, Ambassador Tunde Oladunjoye and Honorable Fasiu Bakenne.

The plaintiffs, are by the committal proceedings, seeking to commit the alleged contemnors to prison for allegedly disobeying the court’s judgment given on the 2nd of May this year, in which it among others, ordered that all dealings with the party in Ogun State should be through the Executive Committee led by Chief Dayo.

Meanwhile the Court of Appeal today also made an order staying execution of an earlier judgment given by Justice Achibong on the 27th of January 27, 2011 which declared the then  Harmonisation Committee led by Dayo Soremi as the party’s authentic management body in the state.

The court of appeal also stayed proceedings in all the contempt proceedings pending the determination of the main appeal by the PDP and its national leaders which challenged the jurisdiction of the Federal High  Court to give  judgment in a case challenging the activities of a political party.
