legal practitionersA lawyer, Kenneth Odidika says that the Speaker of the House of Representatives, Aminu Tambuwal who recently defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) is supposed to vacate the seat as the speaker of the House.

Mr Odidika stated that Honourable Tambuwal became the Speaker of the House under the ticket of the PDP and cannot be the speaker under the opposition party.

Speaking as a guest on Channels Television’s Saturday Sunrise, the legal practitioner noted that Section 68,  sub section 1(g) of the Nigerian Constitution stated that “it is mandatory that he must leave. The moment he left the PDP to APC without emotions or sentiments”.

He further explained that if a legislator moved from his party to another party while his tenure had not ended he ‘shall’ vacate the seat.

A PDP Chieftain, Bukola Olopade, also on the programme, insisted that that the Speaker of the House of Representative, should have resigned after his defection from the PDP to the APC.

“If the Speaker had resigned he would be a hero today,” she said.
