NFFThe legal action challenging the legality of the Unity Party of Nigeria (UPN) and the Social Democratic Party (SDP) has been adjourned till December 9 for mention.

Justice Gabriel Kolawole adjourned the case following the absence of the two parties in court, the parties were said not to be in court following the plaintiff’ inability, Richard Akintola, to serve the originating summon.

When the case was called counsel to INEC, who is the first defendant in the suit Ibraham Bawa, informed the court he was present in court as a mark of respect though he has not been properly served.

In the same vein, counsel to the plaintiff, James Abba, admitted that the political parties could not be served because of difficulties in locating there national secretariat, he then urged the court for a short adjournment to enable him do needful.

Justice Kolawole consequently adjourned the matter till December 9 fermentation.

Mr Richard Akintola had sued INEC and the two parties challenging the legality of their registration as political parties in Nigeria.

He contended that the 1984 Decree had proscribed the UPN, while another Decree of 1993 proscribed the SDP as political parties.

He further contends that that the two decrees must first be repealed before they can be registered as political parties and therefore asked the court to nullify the purported registration.
