The supreme court has again reaffirmed its judgment ordering the sack of a member of the House of Representatives representing, Vandikwa/Konshisha constituency, Honourable Herman Hembe.

Hembe has been charged by the court to return all salaries and allowances collected before his removal from office by the apex court.

Hembe has earlier approached the court, seeking a review of the judgment as it relates to the refund of salaries and allowances.

The five-man panel of the court headed by the Chief Justice of Nigeria struck out the application on Wednesday, on the ground that the law does not allow the court to review its own judgment whether rightly or wrongly taken.

The court also awarded a five million naira cost against mister Hembe after his counsel withdrew the application for the review of the judgment.

The apex court had on July 17, 2017 declared the seat of the lawmaker vacant and ruled that Mrs Dorathy Mato, who won the All Progressives Congress (APC) party ticket for the constituency is the rightful candidate.

The court, in its ruling, ordered Honourable Hembe to return all salaries and benefits collected while in office within 90 days.

Justice Onnoghen declared that Mrs Dorothy Mato was the rightful winner of the APC ticket for Vandikwa/Konshisha federal constituency of Benue State, and hence the winner of the election that produced Hembe as winner.
