Court Dismisses Application Seeking To Restrain Buhari From Swearing In Ministers

A Federal High Court in Abuja has struck out a motion seeking to stop President Muhammadu Buhari from inaugurating the 43 ministerial nominees over alleged deliberate exclusion of an FCT indigene from his ministerial list.

Justice Taiwo Taiwo in his ruling on Monday dismissed the application on the ground that the court lacks the power to grant an interim injunction where the applicant has failed to establish his legal rights in the matter.

The applicant, Musa Baba-Panya, who is also the counsel in the case, had, on Thursday, approached the court with an exparte motion, asking the court to stop the president from going ahead with the inauguration.

Mister Baba-Panya, who is also an indigene of Karu in the Federal Capital Territory (FCT), in his suit, argued that the president’s action was contrary to an Appeal Court judgment delivered on March 15, 2018.

President Buhari is the second defendant while the Attorney General of the Federation (AGF) is the second defendant.
