Appellate Court Dismisses Zamfara PDP Governorship Primary Appeal

The Appellate Court (Sokoto division), has struck out an appeal by the Zamfara People’s Democratic Party (PDP) and three others, seeking to uphold the party’s governorship primary which earlier held in Zamafra State. 

According to the court, the appeal had to be dismissed for lack of merit.

The Presiding judge Muhammad Shuaibu while reading the judgement described the appeal as a mere academic exercise, one that cannot be entertain by the appellate court.

Justice Shuaibu stated that the appellants – Zamfara State PDP, Lawal Dauda Dare, Adamu Maina Waziri, and Bala Bande, have their constitutional rights to appeal, however, the judge added that the issue before the court is beyond the stipulations of the individual’s constitutional right.

Justice Shuaibu said by complying with the order of the lower court and participating in the fresh primary, the appellants have lost the right to appeal.

The judge also upheld the decision of the lower court that nullified the party’s primary election that produced Dauda Lawal Dare for some irregularities that denied women delegates from participating in the conduct of the primaries and orders a fresh primary elections.

The appellate court further awarded a cost of one hundred thousand naira (N100,000) against the appellants for filing preliminary objection that consume substantial time of the court.
