A Federal High Court Abuja has nullified the executive committee of the African Democratic Congress (ADC) led by Ralph Nwosu.

Justice Binta Nyako while delivering her ruling also affirmed Senator Patricia Akwashiki as the authentic national chairman of the party.

In her ruling, Justice Nyako held that the ADC and Nwosu did not dispute the claims of wanting to extend their tenure and as such the claims were deemed admitted.

The trial judge also held that the party was bound by its extant constitution and therefore, the actions taken by the defendants were unconstitutional, null and void, and of no legal effect whatsoever.

Justice Nyako, therefore, ordered the ADC to conduct a special convention for the position of the National Chairman and the members of the National Working Committee within the party.

According to Akwashiki’s counsel, Benson Igbanoi, by the court order, the actions of the Nwosu-led executive between August 21 and December 20, including the sack of the presidential candidate, Dumebi Kachikwu, have been invalidated.

The matter commenced on Tuesday by means of an originating summons filed on August 30, by one Kingsley Ogga against the ADC and two others, to determine amongst others whether, having regards to Article 24 (a) of the Constitution of the African Democratic Congress 2018 (as amended), the National Officers of the party can be validly elected or their term of office extended other than by the National Convention of the 1st Defendant.

The plaintiff also sought a declaration that the tenure of the National Chairman and members of the National Working Committee of the ADC who were elected and sworn into office at the National Convention of the 1st Defendant held on the 28th day of August 2018 expired by effluxion of time upon the expiration of 4 years from the date of their being sworn in being midnight on the August 27, 2022.
