Less than 48hours after the Federal High Court sitting in Ikeja, Lagos dismissed its case against the Federal Government over alleged violation of the rights of its members during the January fuel subsidy protest, the Save Nigeria Group (SNG) has refiled the suit.

Justice Stephen Adah had struck out the suit on the grounds that it was commenced through a motion on notice instead of an originating process which is a fatal defect that could not be overlooked as a mere irregularity.

The court had also held that the non-compliance with the rules had robbed it of the jurisdiction to entertain the matter.”

The SNG wants the court to award the sum of N100 million against the Federal Government for allegedly violating its members’ rights by deploying military troops to stop its protest on the 16th of January at the Gani Fawehinmi Freedom Park, Ojota in Lagos.

The respondents in the suit are President Goodluck Jonathan, the National Security Adviser, Gen. Andrew Azazi; the Chief of Defence Staff, Air Marshall Oluseyi Petinrin; and Chief of Army Staff, Lt.-Gen. Azubuike Ihejirika.

Others are the Inspector-General of Police, Mohammed Abubakar; and the Attorney General of the Federation, Bello Adoke.

No date has however been fixed for the hearing of the new suit.
