The Supreme Court has asked the Federal High Court sitting in Abuja to hear a suit challenging the nomination of Governor Aminu Tambuwal in respect of the 2015 governorship election by the All Progressives Congress (APC).
The suit was filed by another governorship aspirant, Senator Umaru Dahiru, challenging the nomination of the Governor by the All Progressives Congress (APC) on the ground that he has sufficient cause to do so.
In a unanimous decision by a five-man panel of the Supreme Court justices, the apex court held that to agree with Tambuwal that the primary election that produced him could not be challenged by another governorship aspirant, would mean that democracy would be circumvented by the Governor.
The apex court therefore ordered the Federal High Court in Abuja to retry the case on its merits and make a decision as demanded by law.
