Following a Caveat filed at the Probate Registry of a Lagos High Court, seeking to challenge the distribution of the late Chief Executive Officer, Access Holdings, Herbert Wigwe’s estate as outlined in his will, the registry has issued an eight-day ultimatum to Christian Wigwe to enter an appearance.
The registry directed that he should enter an appearance within eight days either in person or by his lawyer over his interest in the late Wigwe estate.
In a Probate Form 7 warning to Caveator on Order 62 Rule 18(8), the Registry directed Christian Chukwuka Wigwe to within eight days after service, set forth his interest in his late business mogul’s estate or otherwise if he has no contrary interest but wishes to show cause against the sealing of a grant to such party to issue and serve a summons for direction by the Registrar of the registry.
The registry stated that he should “take notice that in default of your so doing, the Court may proceed to issue a grant of Probate or Administration in the said Estate notwithstanding your Caveat.”
The issuance of the warning notice was at the instance of Uchechukwu Wigwe (the Warning Party), appointed as Personal Representative of the Estate of the deceased by virtue of the deceased person’s Will, dated July 9, 2013.
