Justice Gabriel Kolawole postponed the ruling which was supposed to be delivered today on the grounds that the first accused person, Mr. Charles Okah who filed the appeal was absent in court following his admission at the prison clinic as a result of ill health.

Justice Kolawole condemned the refusal of the prison officials to allow the family members of the accused person to visit him on the grounds that his wife smuggled a phone to him.

The judge also received the report of the visit of the counsels to the prison in Kuje to ascertain the true state of the living condition of the accused persons following their complaint of ill treatment by prison officials.

Justice Kolawole informed the court that he will make a pronouncement on the matter on the next sitting.

He however denied the appeal by prosecution counsel on behalf of the prison officials calling for the transfer of the accused persons to the cell of the State Security Service saying it will be a failure on the part of the prison service if it cannot perform its statutory responsibility as no one is above the law, he ruled that the accused persons be remanded in Kuje prisons and be produced at the next adjourned date.

Mr. Charles Okah and three other persons are standing trial for the October 1st, 2010 bombing in Abuja the nation’s capital.
