The suit filed by Taraba state governor, Danbaba Suntai against the speaker and Taraba State House of Assembly suffered a setback as hearing could not commence due to late response of the plaintiff counsel to the preliminary objections of the defence counsel.

Adjourning the case to Tuesday for hearing, Justice Ali Andenyangtso averred that in the spirit of fair hearing all parties should be given ample time and opportunity to respond to processes served in respect of the matter.

A Taraba High Court granted and ordered a leave to hear the suit filed by Governor Danbaba Suntai against the speaker and members of Taraba state House of Assembly, pending application during the court vacation, last week Thursday.

Justice Ali Andenyangtso, in his ruling granted accelerated hearing, abridging the time to five days for defendants to appear and file counter affidavit, written addresses to plaintiff’s originating summons and motion on notice for interlocutory injunction.

In the originating summons filed by Alex Izinyon (SAN), on behalf of Governor Danbaba Suntai, requesting the court to determine whether by virtue of section 190 sub section 2 of the 1999 constitution of the Federal Republic of Nigeria (as amended), the speaker and the Taraba State House of Assembly can by press release or debate, interfere with, do anything whatsoever, in connection with or in relation to the letter transmitted by the governor to the speaker of the state house of assembly pursuant to the said section of the constitution.

The governor is now seeking relief for a declaration that the letter is absolute, mandatory obeisant, immutable and cannot be debated or contradicted by any means and has automatically assumed his powers and responsibilities as governor of Taraba state.
