
The All Progressive Grand Alliance (APGA) has asked a Federal High Court in Abuja to declare the seat of Imo State Governor, Rochas Okorocha vacant for defecting to the All Progressives Congress (APC).
In the suit filed by Mister Victor Odjemu on behalf of the party, APGA is praying the court for an order directing the Deputy Governor of Imo State or the Speaker of the State House Of Assembly or any officer next in line to the position of the governor of Imo who is a member of APGA to be sworn-in as the governor of Imo State.
The All Progressive Grand Alliance made its requests in line with section 191(1) and (2) of the 1999 Constitution. Okorocha, INEC and the Imo State House of Assembly are listed as the 1st to 3rd defendants in the suit.
They also argued that the Imo State governorship mandate remains with the APGA, by the provisions of section 177(c) and 221 of the 1999 Constitution and section 97 of the Electoral Act, 2010 (as amended) and the effect of the Supreme Court decision in the Amaechi vs. INEC case.
The party is also asking the court for an order directing the 2nd defendant, the Independent National Electoral Commission (INEC) to issue a Certificate of Return to the deputy governor or any other member of the party, and an order annulling the Certificate of Return issued to Mister Okorocha by virtue of his defection to the APC.
No date has been fixed for the hearing of the suit.
