Striker for Wales and Sheffield United 23 year old Ched Evans has been convicted for having sex with a drunken woman who did not give her consent as he has asked to serve five years for the crime.
Although the football who is considering an appeal against the judgement given by the jury at the Crown Court in Caernarfon in Wales was with a friend a footballer too playing for Port Val
e as a co-defender Clayton McDonald that night also stood as a co-defendant but was found not guilty even though he also had intercourse with the drunk woman the night of the incident.
The two players who met at the Manchester City youth academy 10 years kept in touch as friends by going to gigs and doing stuffs together.
The said woman whose name was not mentioned due several reasons said she had very vague memory of the incident and the prosecution said she was just too drunk to have consented having sex with both men at the Premier Inn near Rhyl.
According to Evan’s lawyers, he was too shocked, too disappointed and dazed by the final verdict the jury gave as he maintained that he is innocent in the matter.
The incident which happened after a night outing on May 29, 2011 and McDonald Evan’s friend met the so called woman on the street of the seaside town after visiting a takeaway and took her back to the hotel and that was where they had sex.
After a while, Evans joined them in the hotel and he also had sex with the woman.
Mr McDonald claimed that Evans asked if he could get involved, while Evans said it was Mr McDonald who asked him if he wanted to have sex with the woman.
McDonald claimed also that the woman gave consent because she was moaning and groaning while the intercourse was going on and that she was in control of her actions.
The Judge Merfyn Hughes while giving her judgement stated that the complainant who is 19 years was extreme intoxicated so she was not in her right senses to consent to sex and then she gave her judgement of five years jail term of which Evans must serve half of the five years at least so as to be entitle to parole.
